By accessing or using the website at casagrandedeckandfence.com or by requesting services from Casa Grande Deck & Fence, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this website or engage our services.
These terms apply to all visitors to the website and to all customers who engage Casa Grande Deck & Fence for construction, installation, repair, or related outdoor improvement services.
Casa Grande Deck & Fence provides residential deck building, fence installation, pergola construction, and related outdoor structure services for homeowners in Casa Grande, AZ and surrounding communities. Specific services, scope of work, materials, and timelines are defined in written project agreements and are subject to change based on site conditions, permit requirements, material availability, and other factors outside our direct control.
This website provides general information about our services. It does not constitute a contract, warranty, or guarantee of any specific outcome, price, or timeline.
Estimates provided verbally or in writing are based on information available at the time of the estimate and are subject to change. A written project agreement signed by both parties constitutes the binding price for the described scope of work.
Changes to the scope of work requested by the customer after a contract is signed may result in change orders that affect the total project cost and timeline. All change orders will be documented in writing and require customer approval before additional work proceeds.
Prices are not guaranteed until a written contract is executed. Estimates expire 30 days from the date of issuance unless otherwise noted in writing.
Project start dates are scheduled based on permit approval timelines, crew availability, and material lead times. We will communicate scheduling updates to you throughout the process. Start dates may shift due to factors outside our control, including permit delays, weather, or material backlogs.
Cancellations made before work begins may be subject to a fee to cover design, permitting, or material costs already incurred. The cancellation terms for your specific project will be set out in your written project agreement.
If a customer requests a suspension or delay of work after it has started, additional costs may apply for remobilization, material restocking, or extended permit timelines.
Payment schedules and methods are specified in each written project agreement. Typically, a deposit is required before work begins, with remaining balances due at defined milestones or upon project completion. Final payment is due upon substantial completion of the work described in the contract.
Late payments may be subject to interest or fees as described in the written agreement. Casa Grande Deck & Fence reserves the right to suspend work on a project if payments are not received according to the agreed schedule.
Customers are responsible for all costs associated with collecting overdue payments, including reasonable legal fees.
Casa Grande Deck & Fence will apply for required building permits as part of the project process unless otherwise agreed in writing. Permit fees are the responsibility of the customer and will be included in the project estimate.
The customer is responsible for providing accurate information about property lines, HOA requirements, and any easements or restrictions that may affect the project. Casa Grande Deck & Fence is not liable for permit rejections, fines, or required modifications resulting from inaccurate information provided by the customer.
The customer agrees to provide reasonable access to the project site during scheduled work hours. This includes ensuring that gates, fencing, and other access points are unlocked and that pets, vehicles, and personal property are cleared from the work area before crews arrive.
The customer is responsible for identifying and marking any underground utilities, irrigation lines, or other below-grade features in the work area that may not be covered by standard utility locating services.
Casa Grande Deck & Fence provides a workmanship warranty as described in the written project agreement. This warranty covers defects in workmanship and installation for the period specified in the agreement.
Material warranties are provided by the respective manufacturers and are separate from our workmanship warranty. We will assist customers in understanding and pursuing valid manufacturer warranty claims, but we are not responsible for defects or failures in materials that result from manufacturer defects.
Warranties are void if the structure is modified, improperly maintained, subjected to misuse, or damaged by events outside our control including extreme weather, flooding, or impact damage.
To the fullest extent permitted by applicable law, Casa Grande Deck & Fence is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this website, reliance on information provided on this website, or from any services provided under a project agreement.
Our total liability to any customer for any claim arising from a project shall not exceed the total amount paid by that customer under the written project agreement for the specific project giving rise to the claim.
This website and the information it contains are provided on an "as is" basis without warranties of any kind, express or implied. Casa Grande Deck & Fence makes no representations about the accuracy, completeness, or suitability of the information on this website for any particular purpose.
General estimates, project timelines, and material descriptions on this website are for informational purposes only and do not constitute guarantees of specific outcomes for any individual project.
We encourage customers to contact us directly at contact@casagrandedeckandfence.com or (520) 598-0105 to resolve any concern before pursuing formal dispute resolution. We will make a good-faith effort to address any issue promptly.
If a dispute cannot be resolved informally, the parties agree to first attempt mediation through a mutually agreed mediator before pursuing litigation. The costs of mediation will be shared equally unless otherwise agreed.
These Terms and Conditions are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought in a court of competent jurisdiction located in Arizona.
